Cross-Appeals

Jurisdictional & Appellate Practice Terms

Definition

Independent, parallel appeals filed by both opposing parties against the exact same judgment or decree, each challenging distinct parts of the ruling that went against their respective claims.

Example

In a tort claim, the trial court awards ₹10 lakh out of a ₹50 lakh claim. The defendant files an appeal claiming zero liability, while the plaintiff files an appeal claiming the full ₹50 lakh; the appellate bench hears both cross-appeals together.
