Abuse of the Process of the Court
Jurisdictional & Appellate Practice Terms
Definition
The improper, malicious, or vexatious use of judicial machinery to achieve an unlawful end, harass an opponent, cause delay, or re-litigate settled disputes, empowering the court to dismiss proceedings and levy heavy exemplary costs.
Example
A plaintiff who loses an eviction suit at the Supreme Court level instigates their relative to file a fresh civil suit in an outlying taluk court claiming an identical tenancy; the court dismisses the suit for abuse of the process of the court.
