Perversity in Appellate Review

Jurisdictional & Appellate Practice Terms

Definition

A recognized legal ground for an appellate court to reverse lower court findings, established when a lower court's conclusion is based on no evidence, ignores vital material evidence, or is so completely irrational that no reasonable person could ever have arrived at it.

Example

A trial judge decrees a suit for specific performance despite the admitted document stating on its face that the contract expired 10 years ago and no consideration passed; the appellate court sets aside the decree on the ground of perversity.
