Interference with Concurrent Findings of Fact
Jurisdictional & Appellate Practice Terms
Definition
The strict appellate principle that a second appellate court (such as the High Court under Section 100 CPC or the Supreme Court under Article 136) will not interfere with identical findings of fact reached by both the trial court and the first appellate court, unless those findings are patently perverse.
Example
Both the trial court and the District Court find as a matter of fact that the plaintiff was in continuous physical possession of a house; the High Court in a Regular Second Appeal refuses to re-examine witness credibility on that point.
