Admiralty Jurisdiction

Jurisdictional & Appellate Practice Terms

Definition

The specialized statutory and inherent jurisdiction exercised by designated High Courts (such as Bombay, Calcutta, Madras, Gujarat, etc.) over maritime claims, vessel collisions, salvage operations, cargo damage, and the arrest of ships.

Example

A foreign-flagged oil tanker docks at the port of Kandla owing unpaid bunker fuel bills; the creditor moves the High Court of Gujarat under its admiralty jurisdiction to secure an order for the immediate arrest of the vessel.
