Submission to Jurisdiction

Jurisdictional & Appellate Practice Terms

Definition

The affirmative act of a defendant appearing in a court that might otherwise lack personal or territorial jurisdiction over them, taking steps in the proceedings, and submitting to its judicial determination without protest.

Example

A foreign defendant served with a civil summons in an Indian court files an application seeking extension of time to file a written statement without reserving their right to challenge jurisdiction; this conduct constitutes a submission to jurisdiction.
