Non-Exclusive Jurisdiction Clause
Jurisdictional & Appellate Practice Terms
Definition
A contractual clause specifying that a particular court has jurisdiction over disputes, but without barring either party from initiating legal proceedings in other courts that otherwise possess lawful statutory jurisdiction.
Example
A shipping charter states: "Parties agree to the non-exclusive jurisdiction of the English High Court." Either party may initiate proceedings in London, but they remain free to sue in Singapore or Mumbai if the vessel is arrested there.
