Inherent Powers to Prevent Abuse of Process

Jurisdictional & Appellate Practice Terms

Definition

The fundamental, unwritten authority of superior courts (codified in Section 151 CPC for civil matters and Section 482 CrPC / Section 528 BNSS for criminal matters) to make orders necessary to achieve justice and crush vexatious, fraudulent, or harassing litigation tactics.

Example

A litigant files six consecutive identical applications across different dates attempting to re-argue a point already finalized by a Division Bench; the court invokes its inherent powers to dismiss the application and prohibit further filings without prior leave.
