Cross-Objection (Order XLI Rule 22 CPC)
Jurisdictional & Appellate Practice Terms
Definition
A procedural right enabling a respondent in a civil appeal, who may not have filed an independent appeal against the original decree, to challenge an adverse finding or part of the decree during the hearing of the opponent's appeal.
Example
A plaintiff sues for ₹10 lakh; the trial court decrees ₹6 lakh and rejects ₹4 lakh. The defendant appeals against the ₹6 lakh award. The plaintiff, without filing a separate appeal, files a cross-objection arguing that the trial court erred in denying the remaining ₹4 lakh.
