Maintainability vs. Merits

Jurisdictional & Appellate Practice Terms

Definition

Maintainability: The threshold question of whether a court possesses the legal jurisdiction and power to entertain a petition or suit (e.g., limitation, standing, alternate remedy).

Merits: The substantive evaluation of whether the allegations, facts, and evidence presented by the parties entitle them to legal relief.

Example

A writ petition against a private school for terminating a teacher is dismissed on grounds of maintainability (the school is not an instrumentality of State under Article 12) without the court ever evaluating the merits of whether the termination was fair.
