Rejection of Plaint (Order VII Rule 11 CPC)
Jurisdictional & Appellate Practice Terms
Definition
An order summarily terminating a plaint without trial where it does not disclose a cause of action, is undervalued, insufficiently stamped, or barred by any law (such as the Law of Limitation or res judicata).
Example
A plaint shows on its face that the monetary claim arose eight years ago with no written acknowledgment of debt; the defendant moves an application under Order VII Rule 11(d) CPC, and the court rejects the plaint as barred by limitation.
