Caveat (Section 148A CPC)

Jurisdictional & Appellate Practice Terms

Definition

A formal preventive notice filed by an individual or entity anticipating that a suit, appeal, or application will be instituted against them, obligating the court registry and the opposing party to serve notice before any ex-parte interim order can be passed.

Example

A construction company wins a high-value infrastructure contract; anticipating that the disqualified second bidder will file a writ or commercial suit seeking an interim stay, the company lodges a caveat in the High Court.
