Supervisory Jurisdiction (Article 227)

Jurisdictional & Appellate Practice Terms

Definition

The constitutional power of superintendence vested in every High Court over all subordinate courts and tribunals within its territorial limits, exercised sparingly to keep lower judicial bodies within the bounds of their legal authority.

Example

A state rent control tribunal continues to conduct trials and pass eviction orders despite the subject building being situated in a cantonment zone governed exclusively by Central military boards; the High Court intervenes under Article 227 to quash the proceedings.
