Error Apparent on the Face of the Record

Jurisdictional & Appellate Practice Terms

Definition

A patent, self-evident judicial error that is clear upon a mere glance at the judgment and records without needing elaborate arguments, protracted reasoning, or fresh evidentiary inquiry.

Example

The court issues an adverse cost order against a party explicitly citing Section "X" of an Act, whereas the official gazette shows Section "X" was struck down as unconstitutional three years prior; this is an error apparent on the face of the record.
