Civil Revision (Section 115 CPC)

Jurisdictional & Appellate Practice Terms

Definition

A supervisory proceeding before the High Court allowing it to examine the record of any case decided by a subordinate court from which no appeal lies, strictly confined to checking whether the lower court exercised jurisdiction not vested in it, failed to exercise vested jurisdiction, or acted with material irregularity.

Example

A trial judge dismisses a defendant's application to reject a plaint under Order VII Rule 11 CPC on an unappealable procedural point without applying the statutory limitation test; the defendant files a Civil Revision under Section 115 CPC before the High Court.
