Regular Second Appeal (RSA - Section 100 CPC)

Jurisdictional & Appellate Practice Terms

Definition

A narrow civil appeal lying to the High Court against an appellate decree passed by a District Court, maintainable solely if the High Court is satisfied that the case involves a "substantial question of law."

Example

A defendant loses a land title dispute at both the trial court and the first appellate district court; they file an RSA before the High Court, which admits the appeal exclusively to formulate a substantial question of law regarding the statutory presumption of an unprobated will.
