Statutory Appeal

Jurisdictional & Appellate Practice Terms

Definition

An appeal created, conferred, and regulated strictly by the express text of a legislative enactment (such as under Section 374 CrPC/BNSS or Section 96 CPC), which exists purely as a creature of statute rather than an inherent common law right.

Example

Section 62 of the Insolvency and Bankruptcy Code provides a statutory appeal directly to the Supreme Court on a question of law arising out of an order passed by the National Company Law Appellate Tribunal (NCLAT).
