In Limine

Jurisdictional & Appellate Practice Terms

Definition

"At the threshold." Refers to a superior court summarily dismissing or rejecting an appeal, writ, or application at the initial admission stage without issuing notice to the respondents or conducting a full final hearing on merits.

Example

A petitioner files an Article 32 writ petition before the Supreme Court seeking the recovery of money lent under an informal personal promissory note; the Supreme Court dismisses the petition in limine as non-maintainable.
