Coram Non Judice

Jurisdictional & Appellate Practice Terms

Definition

"Before one who is not a judge." Describes legal proceedings, trials, or orders conducted or passed by a court or authority that completely lacks jurisdiction (territorial, pecuniary, or subject-matter) over the dispute; such proceedings are void ab initio.

Example

If a consumer disputes forum entertains a suit to declare a registered title deed of immovable property null and void on grounds of fraud, the resulting decree is coram non judice and unenforceable.
