Doctrine of Constitutional Silence

Constitutional & Public Law Doctrines

Definition

The judicial acknowledgment that the written text of the Constitution may intentionally leave gaps, silences, or unstated assumptions, which courts must interpret harmoniously using democratic values, conventions, and foundational structure.

Example

The Constitution does not specify the method for selecting members of the Election Commission of India; in Anoop Baranwal v. Union of India, the Supreme Court filled this constitutional silence by directing an independent selection committee until Parliament enacted a law.
