Wednesbury Unreasonableness

Constitutional & Public Law Doctrines

Definition

A standard of judicial review in administrative law derived from Associated Provincial Picture Houses v. Wednesbury Corp., stating that a court will intervene only if an administrative decision is so outrageous in its defiance of logic or accepted moral standards that no sensible authority could ever have reached it.

Example

An authority permanently cancels a commercial transport firm's nationwide operating license because one delivery driver was caught without a reflective safety sticker; the penalty is struck down for Wednesbury unreasonableness.
