President’s Rule (Article 356)

Constitutional & Public Law Doctrines

Definition

The constitutional power of the President to assume all or any functions of a State government upon receiving a report from the Governor or otherwise, if satisfied that a situation has arisen in which the government of the State cannot be carried on in accordance with the provisions of the Constitution.

Example

In S.R. Bommai, the Supreme Court held that the invocation of Article 356 is subject to judicial review, and the court can strike down an arbitrary proclamation and restore a dismissed State government if the power was exercised mala fide.
