Exception to Alternative Remedy (Whirlpool Principles)

Constitutional & Public Law Doctrines

Definition

Exceptions established in Whirlpool Corporation v. Registrar of Trade Marks, where a High Court will entertain a writ under Article 226 despite an alternative remedy: (1) violation of Fundamental Rights, (2) total breach of natural justice, (3) proceedings wholly without jurisdiction, or (4) challenge to the ultra vires nature of an Act.

Example

A sales tax officer issues an assessment order freezing a business’s factory without issuing any show-cause notice or opportunity of hearing; the High Court admits the writ directly because the order violates natural justice.
