Epistolary Jurisdiction

Constitutional & Public Law Doctrines

Definition

The relaxation of formal pleading requirements in Public Interest Litigation (PIL), where the Supreme Court or High Courts accept informal letters, telegrams, postcards, or newspaper clippings as writ petitions under Articles 32 and 226 (Bandhua Mukti Morcha).

Example

A social worker writes an ordinary postcard to the Chief Justice of India documenting bonded laborers held in stone quarries; the Supreme Court converts the postcard into a registered Article 32 writ petition and appoints an inquiry commission.
