Continuous Mandamus

Constitutional & Public Law Doctrines

Definition

A procedural innovation where a constitutional court, rather than disposing of a writ petition with a single final decree, keeps the petition pending for years, issuing successive interim orders and monitoring executive compliance through periodic status reports.

Example

In the T.N. Godavarman Thirumulpad (Forest Conservation) case, the Supreme Court utilized continuous mandamus for decades to oversee national forest preservation, illegal timber felling, and afforestation fund management.
