Procedure Established by Law

Constitutional & Public Law Doctrines

Definition

The literal phrasing found in Article 21, originally derived from the Japanese Constitution, meaning that no person shall be deprived of their life or personal liberty except in accordance with a procedure enacted by a competent legislative body.

Example

In A.K. Gopalan (1950), this was interpreted restrictively to mean that as long as a validly enacted statute existed, courts could not examine the inherent fairness of the procedural law itself.
