Rule of Law

Constitutional & Public Law Doctrines

Definition

An essential facet of the Basic Structure (recognized in Indira Nehru Gandhi v. Raj Narain), stating that all individuals, institutions, and state entities are accountable to laws that are publicly promulgated, equally enforced, independently adjudicated, and free from executive arbitrariness.

Example

The executive branch cannot arrest a journalist or freeze bank accounts through an informal verbal command without invoking a specific statutory power; doing so violates the Rule of Law.
