Constitutional Morality

Constitutional & Public Law Doctrines

Definition

The principle that state institutions and courts must uphold the overarching democratic values, individual liberty, institutional integrity, and equality embedded in the Constitution, rather than conforming to subjective majoritarian social prejudices.

Example

In Navtej Singh Johar v. Union of India, the Supreme Court decriminalized adult consensual same-sex acts under Section 377, holding that societal disapprobation must yield to constitutional morality under Articles 14 and 21.
