Doctrine of Incidental or Ancillary Powers
Constitutional & Public Law Doctrines
Definition
A rule of constitutional interpretation establishing that the grant of an express legislative power over a broad subject in the Seventh Schedule inherently includes all implied, subsidiary, and ancillary powers necessary to make that primary power effective.
Example
Under the Union List entry for banking, Parliament possesses the ancillary power to create specialized recovery tribunals (DRTs) and legislate on the attachment of collateral, even if court procedure generally appears elsewhere.
